Introduction

vSplash Techlabs, Inc. (“vSplash,” “we,” “us”) is dedicated to safeguarding your privacy. This Privacy Statement applies to both the vSplash website and our services platform.

This Privacy Policy explains how we collect, use, share, and protect information, including our adherence to the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) with respect to personal data transferred from the European Union, the United Kingdom, and Switzerland.

If you are located in the EU, UK, or Switzerland, this Policy describes your rights under these frameworks and how to exercise them.

As a white-label service provider, vSplash does not collect personal information directly from individuals. Instead, we process non-HR personal data under the direction of our Clients (agencies). Our Clients are responsible for providing their customers with any required notices and obtaining consent where applicable.

By using the vSplash website or its services platform, you consent to the data practices described in this Statement.

Information Related to Data Collected and Processed for Our Clients

Service Provider Role

  • vSplash collects and processes information strictly under the direction of its Clients.
  • We have no direct relationship with the individuals whose personal data we process.
  • Clients are responsible for providing notice to their customers about the purposes for which personal data is collected.

Choice
If you are an individual who interacts with one of our Clients and you no longer wish to be contacted, please contact the Client directly. If you are a vSplash Client and wish to update your account, please contact us.

Onward Transfers
vSplash may transfer personal data to sub-processors or service providers assisting us in delivering services. These transfers are subject to contractual agreements and the accountability provisions of the EU-U.S. DPF, UK Extension, and Swiss-U.S. DPF.

Access to Data Controlled by Our Clients
vSplash acknowledges that individuals in the EU, UK, and Switzerland have rights to access, correct, amend, or delete personal data. However, as a processor, vSplash has no direct relationship with individuals.

If you seek to exercise your rights, please contact the relevant Client directly. Alternatively, you may contact us at support@vsplash.com, and we will coordinate with our Client to respond.

Data Integrity and Purpose Limitation
We take reasonable steps to ensure data we process for our Clients is:

  • Reliable for its intended use
  • Accurate, complete, and current
  • Retained only as long as necessary to provide services, comply with legal obligations, or as directed by Clients

Website Collection and Use Practices
vSplash collects personally identifiable information from users of its website, such as email addresses, names, company names, home, and/or work addresses, and/or telephone numbers.

In the event that you contact us for customer support through the website, we may also request that you provide additional User Information relevant to the support requested by you. Users are under no obligation to provide such information. However, we cannot guarantee that we can provide customer support in the event that relevant information related to the use of our products or services is withheld. We may retain communications relating to customer support, and/or information drawn from such communications, for statistical and/or reference.

Compliance with the EU-U.S., UK Extension, and Swiss-U.S. Data Privacy Frameworks
vSplash complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data transferred from the EU, UK, and Switzerland to the United States.

  • vSplash has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. DPF Principles, the UK Extension Principles, and the Swiss-U.S. DPF Principles.
  • If there is any conflict between this Privacy Policy and those Principles, the Principles shall govern.

vSplash is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC).

Rights of EU, UK, and Swiss Individuals
Individuals in the EU, UK, and Switzerland have the right to:

  • Request confirmation of whether we process your data
  • Access your personal data
  • Correct, amend, or delete inaccurate information
  • Restrict or object to processing in certain cases

Requests should be sent to support@vsplash.com, and we will coordinate with our Clients as needed. We respond within a reasonable timeframe.<

Your right to access may be restricted in limited cases, such as when providing it would infringe on others’ rights.

Accountability for Onward Transfers
vSplash remains responsible and liable under the EU-U.S. DPF, UK Extension, and Swiss-U.S. DPF Principles for any personal data we transfer to third parties who process it on our behalf, unless we prove we are not responsible for the event giving rise to the damage.

Dispute Resolution
In compliance with the DPF Principles, vSplash commits to resolve complaints about our handling of personal data transferred to the U.S. under the EU-U.S. DPF, UK Extension, and Swiss-U.S. DPF.

Additional Disclosures

  • We may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
  • We will provide opt-in or opt-out choice before sharing data with third parties other than agents or using it for a materially different purpose.

Security
We use industry-standard administrative, technical, and physical safeguards to protect data, including encryption for sensitive transmissions. However, no method of transmission or storage is 100% secure.

Data Retention
We retain personal data only as long as:

  • Directed by our Clients
  • Necessary to provide services
  • Required for legal, contractual, or regulatory obligations

Afterward, data is securely deleted or anonymized.

Changes to This Policy
We may update this Privacy Policy from time to time. If material changes are made, we will notify Clients by email or post a notice on our website prior to the changes taking effect.
